1. Operating Entity & Acceptance of Terms

The Platform is owned and operated by LITELINK CONSULTANCY LLP, a limited liability partnership registered under the laws of India (hereinafter referred to as "Hosticky", "Company", "we", "us", or "our").

By accessing, browsing, registering for an account, or purchasing any web hosting services, cloud servers, software, domains, or digital items on this Platform, you (the "Customer", "User", or "you") agree to be bound by these Terms of Use and all related policies incorporated herein by reference, including our:

• Privacy Policy
• Digital Personal Data Protection (DPDP) Compliance Policy
• Refund & Cancellation Policy
• GPL & Digital Products Policy
• Acceptable Use Policy (AUP)
• Service Level Agreement (SLA)

2. Account Registration & Security

To access and use Hosticky services, you must provide accurate, current, and complete registration details (including legal name, contact email, phone number, and billing address). You are solely responsible for maintaining the confidentiality of your account credentials, password, and two-factor authentication tokens. You agree to notify us immediately of any unauthorized use or security compromise of your account.

3. Payments, Billing & Invoicing

3.1 Invoice Generation & Due Dates: Renewal invoices are generated automatically prior to your service renewal date. It is your responsibility to ensure that all invoices are paid on or before the due date.

3.2 Suspension & Termination for Non-Payment: Failure to settle invoices by the due date may result in automated temporary service suspension. If an invoice remains unpaid after the applicable grace period, the service will be permanently terminated and all associated hosted data, websites, and databases will be automatically and irrevocably deleted from our servers.

3.3 Upstream Licensing & Price Adjustments: In the event that third-party control panel vendors, virtualization platforms, or software licensing providers (e.g., cPanel, LiteSpeed, CloudLinux) adjust upstream licensing fees, Hosticky reserves the right to revise recurring pricing with prior notice.

4. Strict Non-Refundable & Chargeback Terms

4.1 Immediate Digital Execution: All web hosting resources, cloud VPS allocations, server deployments, domain registrations, software scripts, and GPL digital downloads are provisioned or delivered electronically immediately upon payment. In accordance with applicable digital commerce standards, your statutory right of cancellation or refund is forfeited once digital delivery or service activation begins.

4.2 No Bank or Cash Refunds: As detailed in our Refund Policy, all payments are 100% non-refundable to original payment methods (banks, credit cards, UPI, or PayPal). Any exceptionally approved refund for eligible shared hosting within 30 days is credited strictly as Hosticky Wallet Credit.

4.3 Chargebacks Prohibited: Initiating an unauthorized chargeback or payment reversal without prior written resolution through our support ticket desk constitutes a material breach of this contract. Unjustified chargebacks will trigger immediate permanent account termination, blacklisting, and reporting of digital audit trails (including verified consent timestamps and IP addresses) to banking and fraud prevention registries.

5. Prohibited Activities & Content Restrictions

You agree not to host, upload, transmit, or distribute any content or engage in activities that violate our Acceptable Use Policy (AUP), including but not limited to:

• Media Streaming & File Lockers: High-bandwidth video streaming, audio broadcasting, or public file-sharing download portals on shared hosting plans.
• Network Abuse: Denial of Service (DoS/DDoS) attacks, port scanning, botnets, mail bombing, or vulnerability exploits.
• Malicious Code: Storing, transmitting, or distributing computer viruses, worms, trojans, ransomware, or phishing websites.
• Spam: Sending unsolicited bulk commercial email (spam) or hosting spam-advertised websites.
• Illegal Material: Child exploitation material, unlawful gambling or betting schemes, defamatory content, or items infringing third-party intellectual property.
• Free/Abusive Domains: Free domains (e.g., Freenom extensions) utilized for abusive or deceptive activities.

6. Proprietary Rights & Intellectual Property

All intellectual property rights in the Website design, graphics, software architecture, and branding are the proprietary property of LITELINK CONSULTANCY LLP or its licensors. Software items provided under the GNU General Public License (GPL) are governed strictly by their respective open-source license terms, as described in our GPL & Digital Products Policy.

7. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, LITELINK CONSULTANCY LLP and Hosticky shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of profits, data corruption, or business interruption arising out of your use of our services. Our total aggregate liability under any circumstances shall not exceed the amount actually paid by you to Hosticky for the specific service during the one (1) month immediately preceding the claim.

You agree to defend, indemnify, and hold harmless LITELINK CONSULTANCY LLP, its partners, officers, employees, and agents from any claims, liabilities, damages, or costs (including legal fees) arising from your breach of these Terms, your use of the services, or content hosted on your account.

8. Governing Law & Dispute Resolution

These Terms of Use and any disputes arising out of or related to our services shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts in West Bengal, India.
